DOB issued a violation notice to landlord for putting up an awning structure without first getting a permit from landlord. Landlord claimed that the awning structure wasn't alteration work that required a permit under city law. The ALJ ruled for landlord, and DOB appealed. The ECB ruled for DOB and fined landlord $500. An alteration is any addition, change, or modification of a building that affects safety or health and that isn't minor or an ordinary repair. Landlord's awning was a large metal structure that extended the length of the entire front facade of the building and was permanently attached.
