Permit Not Required for Installing Flue Pipe

DOB issued a violation notice to landlord for installing a flue pipe from the second story to the roof without a permit. The ALJ found there was no violation. Since no walls were broken, no permit was required for installing the flue pipe. DOB appealed, claiming that by law a permit was needed for any addition or alteration of a vent pipe. ECB ruled against DOB. The installation of an external flue pipe to reroute kitchen odors to the roof wasn't a vent extension and didn't require a permit.
