Mt. Vernon landlord applied for MCI rent hikes based on upgrading the building's elevators. The DRA granted the increase, and tenants appealed. They argued that landlord's charges for overtime work shouldn't be included in the rent increase. The DHCR ruled for landlord. Overtime charges can be included in MCI rent hikes if they aren't excessive. In this case, the total cost for the job was approximately $15,000, including $1,000 in overtime. Considering the scope of the work that was done, the overtime charges represent too small a fraction of the overall cost to be considered excessive.
