Cost of Elevator Upgrade Included Overtime

Landlord applied for MCI rent hikes based on elevator upgrading. The DRA ruled for landlord but disallowed the cost of overtime for the acceleration of the elevator installation. Landlord appealed and won. There was only one elevator in the building, and the tenants association complained that taking it out of service would severely impact the lives of disabled and elderly tenants. To prevent relocation of certain tenants, it was necessary to perform the installation on an expedited basis in four weeks instead of seven.

The overtime charges were an actual cost incurred in connection with the MCI, and landlord explained the circumstances involved. The additional $8,000 cost was added to the total cost of the MCI.
