Consulting Fees Not Included in Cost for Installation of Boiler/Burner

Landlord applied for MCI rent increases based on the installation of a new boiler/burner. The DRA ruled for landlord but disallowed $7,500 claimed as the cost of a heating system consulting fee. Landlord appealed. The DHCR ruled against landlord, finding that it wasn't customary or DHCR policy to allow an increase for consulting fees for a boiler/burner, since the contractors who perform those installations have the necessary expertise to ensure that the work meets with governmental approval.
