Costs of Sprinkler and Landscaping Were Included

Landlord applied for MCI rent hikes for sprinkler installation and landscaping. The DRA ruled for landlord. Tenants appealed, claiming that this was merely cosmetic work. The DHCR ruled against tenants. The existing landscaping had to be restored in connection with landlord's replacement of the asphalt parking lot and driveway, another MCI. And the sprinkler system was needed to help preserve the new landscaping work. These items were done in connection with an MCI at the time the other work was done and qualified for MCI hikes.
