Later Base Date Applies

Tenants complained of reduced building-wide services, claiming that there was no doorman, and that lobby furniture and drapes were no longer provided. Tenants claimed that these services had been provided by landlord in May 1974. Landlord argued that the base date for services should be June 1983 since the building was exempt from rent stabilization until that date because it was owned and operated by a college or university. The services in question weren't provided on the June 1983 base date.

The services in question weren't provided on the June 1983 base date. The DRA ruled for tenants and cut the rent, finding that the base date for required services was July 1, 1974. Landlord appealed, and the DHCR revoked the rent cut. The proper base date is June 1983 because that was when the building lost its educational exemption.
