Cost of Air Conditioner Removal/Replacement Included

Landlord applied for MCI rent hikes based on the installation of new windows and related work. The DRA ruled for landlord in part. It granted MCI increases for the window installation but denied increases for removal of air conditioners done in connection with the window installation. Landlord appealed, arguing that the removal and replacement of air conditioners was necessary and directly related to the window installation. The DHCR ruled for landlord. Replacing the air conditioners in a uniform and safe manner was reasonably required by landlord's window replacement. And the Landmarks Preservation Commission required uniform air conditioner replacement in this building.
