Cost of Removing Old Oil Tank Included

Landlord applied for MCI rent hikes based on the installation of a new oil tank. Part of the work included removal of an old oil tank. The DRA ruled for landlord. Tenant appealed, claiming that there should be no rent increase for removal of the old oil tank. The DHCR ruled against tenant. Removal of the old tank was part of the work required for installation of the new tank. So it was properly included as part of the MCI.
