Consultant Fees Included

Landlord applied for MCI rent hikes based on the installation of a new boiler/burner. The DRA ruled for landlord, except that it disallowed any rent increase for heating consultant expenses. Landlord appealed, claiming that a consultant was needed. The building was fully exposed on all sides, so it was hard to heat. The consultant was hired to make sure that the new heating system was properly designed and installed. The DHCR ruled for landlord. The consultant's fees were justified and done in connection with the MCI.
