Work Done Not Specifically Listed

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed, claiming that the DRA unreasonably disallowed a 1/40th rent increase for individual apartment improvements. The DHCR ruled against landlord. The DRA had allowed a rent increase for installation of a new stove and kitchen cabinets. But other work claimed by landlord was ''painting and small jobs done.'' Painting is considered normal repair and maintenance for which no rent increase is granted. And ''small jobs'' didn't specify exactly what was done. The DRA had sent landlord at least two notices asking for further information, but landlord didn't respond with enough information to warrant an additional rent increase.
