Invoice Dated Six Months After Work Done

Tenant complained of a rent overcharge. The DRA ruled against tenant, and tenant appealed. The DRA had allowed a 1/40th rent increase for various apartment improvements. Tenant pointed out that landlord submitted an invoice for electrical work for $2,500, dated six months after tenant moved in. Landlord claimed that the work was done before tenant moved in and that the contractor merely delayed in billing landlord. The DHCR ruled for tenant and disallowed that portion of the cost of landlord's improvements.

There was no explanation why the contractor would have delayed six months in billing for that amount of money. There was a total overcharge of $2,400.
