Tenant complained of a rent overcharge. The DRA ruled for tenant and ordered landlord to refund $13,000. Landlord appealed, claiming that the DRA improperly disallowed a 1/40th rent increase for apartment improvements. The DHCR ruled against landlord. Landlord submitted unitemized invoices as proof of the cost of the work. So the DRA couldn't determine which costs were related to work done at tenant's apartment. The rent increase was properly denied for the claimed apartment improvements.
