Tenants Complain of Leaks from Outer Walls

Landlord applied for MCI rent hikes based on exterior restoration work. The DRA ruled for landlord. Tenants appealed, claiming that despite pointing and window caulking, there was water leakage through the building's outer walls. The DHCR ruled against tenants. The DRA already addressed this issue in its order. The DRA had ordered landlord to investigate and correct prior leak damage in specific apartments. The DRA also exempted two apartments from the MCI rent hike until the leaks were repaired. This was a sufficient remedy, and no further reduction of the MCI rent hike was warranted.
