Tenant Complains of Water Leak from New Roof

Landlord applied for MCI rent hikes based on a new roof installation. The DRA ruled for landlord. But one second-floor tenant was held exempt from the MCI rent hike because of a water leak from his bedroom window. Landlord appealed, pointing out that the building had four stories and that tenant's window leak didn't come from the roof. Landlord also had by now repaired tenant's window. The DHCR ruled for landlord. There was no proof that tenant's window leak was caused by the MCI installation.
