Landlord sued to evict tenant for conducting unlawful activity in his apartment. Witnesses testified that they complained to police that tenant was selling drugs from the apartment. This led to a police investigation and search warrant. Police also set up a sting where heroin was purchased in the apartment from tenant. The court ruled for landlord. Tenant appealed and lost. The facts established that tenant was in material noncompliance with his lease.
