Tenant complained that landlord failed to offer him a renewal lease. The DRA ruled against tenant and found that another apartment occupant had succession rights and was therefore entitled to a renewal lease. Tenant appealed and his PAR was later dismissed based on settlement. Landlord submitted to the DHCR a copy of a settlement agreement signed in court by tenant and landlord. Both sides were represented by attorneys and tenant agreed to withdraw with prejudice his DHCR complaint. Tenant further agreed to take any steps needed to effectuate this withdrawal. Based on the prior settlement agreement, the proceeding was terminated.
