Roof Access

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants and reduced their rents based on finding that landlord no longer provided roof access and roof furnishings. Landlord appealed, claiming that this service was never provided. The DHCR ruled against landlord. A number of tenants stated that picnic tables, benches, umbrellas and large planters had been made available for tenant use in the past. Landlord didn't respond to these claims, even though given an extension of time to do so. Roof access was a base date service previously provided.
