Rent-Stabilized Tenant Can Have Daughter Live with Her

Rent-stabilized tenant's daughter complained to the DHCR that landlord improperly sought to evict her. The DRA ruled for tenant's daughter. Landlord appealed and lost. Landlord claimed that tenant's daughter had no standing to file a DHCR complaint, because she was not tenant. But tenant submitted a sworn statement and other documents showing that her daughter had lived in the apartment with her for 20 years. Tenant was entitled to have a family member live with her. There was no unlawful occupancy.
