Former Hospital Employee Living in Hospital's Building Wasn't Entitled to Rent-Stabilized Lease

An apartment occupant complained to the DHCR that landlord refused to give her a rent-stabilized lease. The DRA ruled against occupant, finding that she initially occupied the apartment as an incident to her employment with Maimonides Medical Center (MMC), which owned the building. Therefore, her apartment was exempt from rent stabilization. Occupant appealed and lost. The DHCR pointed out that another former employee-occupant had complained to the DHCR for the same reason and lost. MMC also had won in housing court against the other occupant because the court also found that the other occupant wasn't entitled to remain as a rent-stabilized tenant after her employment expired.
