Regular Sweeping Schedule Not Shown

The DOS issued a notice of violation to landlord for failing to clean 18 inches into the street on a certain day. The notice stated that debris was matted down and scattered by the curb in front of landlord's building. Landlord claimed that the problem was caused by a catch basin on his block that caused water to back up, leaving garbage in front of his building. Landlord claimed that he swept more than twice daily in front of his building. The ALJ fined landlord $50, and landlord appealed. The ECB denied landlord's appeal. Landlord set forth no regular sweeping schedule except at 8:00-8:30 a.m. and 12:00-12:30 p.m. Also, landlord didn't show that there was water along the curb on the date of the violation
