Landlord applied for MCI rent hikes based on a number of improvements. The DRA ruled against landlord based on landlord's failure to file rent registration statements for 1987. Landlord appealed, claiming that the building had been registered properly in 1987. The DHCR ruled against landlord. The Rent Stabilization Code states that failure to register for any year completely bars landlord from applying for and collecting rent increases until such time as the registration is completed. At that point, the sanction is eliminated prospectively. There was no proof that landlord ever filed the 1987 registration statements with the DHCR.
