Prior Rent Cut Ordered

Rent-controlled tenant asked the DHCR for a rent cut, complaining that landlord hadn't painted his apartment in over three years. The DRA denied tenant's application because tenant had gotten a prior rent cut for peeling paint and plaster. Tenant appealed, arguing that not having his apartment painted on time was a separate defect from the peeling paint and plaster. The DHCR upheld the DRA's order. The prior rent cut was still in effect, and an inspection showed that there were no additional defects in tenant's apartment.
