Permit Required for Pigeon Coop

DOB issued a violation notice to landlord for constructing a pigeon coop on top of her two-story residential building without a permit. Landlord claimed that no permit was needed. The ALJ ruled for landlord and dismissed the violation. DOB appealed, claiming that although the Multiple Dwelling Law permitted land- lord to keep pigeons, landlord needed a permit to build the coop. ECB ruled for DOB and fined landlord $350. There was no exemption from getting a construction permit in the city's rules for keeping pigeons.
