Landlord Responsible for Clearing Pigeon Excrement at Building

The DOH issued a violation notice to landlord for maintaining a nuisance. The violation cited pigeon excrement on the building's front, window sills, and roof ledge. Landlord claimed that pigeons congregated at the building because someone left bird seed in a tree pit near the building every morning. The ALJ ruled against landlord and fined him $1,000. Landlord appealed and lost. It was no defense that feeding pigeons near the building might have caused them to be at the building, and landlord admitted he didn't inspect or clean the roof ledge.
