No Proof of DHCR Inspector Bias

LVT Number: #20629

Tenant complained of a reduction in services based on water seepage to the ceilings of several rooms in her apartment. The DRA ruled for tenant and reduced her rent. Landlord later sought rent restoration based on restoration of services. The DRA ruled for landlord. Tenant appealed, claiming that the building super pressured her to give access before a DHCR inspection date. When she gave access, landlord worked on the bathroom and living room ceilings but didn't fix the master bedroom ceiling.

When she gave access, landlord worked on the bathroom and living room ceilings but didn't fix the master bedroom ceiling. She said that when the DHCR inspector came, he was friendly with the super and spoke to him in Spanish. The DHCR ruled against tenant. The DHCR's inspector found that there were no leak stains or indications of water seepage from the master bedroom walls or ceiling. The inspector noted just one small area of peeling paint at the ceiling around the area of the windows. There was no proof that the inspector was biased or didn't do his job properly.
