Landlord applied for an MCI rent hike based on the installation of new trash compactors. Tenant challenged the application, claiming that the old compactor worked well and didn't need replacing. Tenant also argued that tenants didn't use the new compactors because they had to jump over piles of garbage to get to them. The DRA granted landlord's application, and tenant appealed. Landlord wins. Installing new compactors qualifies for an MCI rent hike because it's a building-wide improvement. It doesn't matter if tenants use the improvement.
