New Skylight Not Installed with Qualifying Improvement

Landlord applied for MCI rent hikes based on the replacement of skylights and a roof hatch. The DRA ruled against landlord. Landlord appealed and lost. The DHCR's position is that skylights and/or roof hatches must be installed in connection with a qualifying improvement such as a new roof to be included as part of an MCI. Landlord already received a separate MCI rent hike for a new roof in 2000. Since the skylights weren't installed until 2003, they weren't done in connection with the roof work.
