Skylight Replacement Related to Roof Work Qualifies as MCI

Landlord applied for MCI rent hikes based on new roofing, including insulation and skylight replacement. The DRA ruled for landlord. Tenants appealed, arguing that the new skylight benefitted only the market-rate apartment on the top floor. The DHCR ruled against tenants. The roof installation benefitted all tenants in the building. The skylight replacement was performed in connection with and was directly related to the roof work and therefore also qualified for an MCI rent hike.
