New Roof Qualifies

Landlord applied for MCI rent hikes based on the installation of a new roof. The DRA ruled for landlord. Tenant appealed, claiming that her top-floor apartment ceiling had been leaking since January 2002, after the new roof was installed. The DHCR ruled against tenant. Landlord claimed that the leak was from a clogged roof drain and had nothing to do with the new roof installation. Landlord filed all the required documents to show that the MCI had been performed properly. And the fact that one tenant may have problems with the work wasn't sufficient reason to deny the rent hike.
