Tenant appealed, claiming that prior landlord actually did the work and told tenants he wouldn't charge them. Tenant claimed that new landlord couldn't get the MCI rent hike. The DHCR ruled against tenant. New landlord could apply for MCI rent hikes based on the work of prior landlord, as long as the application was filed on time and properly supported by contracts, cancelled checks, and other required proof of the installation.
