New Kitchen Floor and Related Improvements

Tenant filed a fair market rent appeal. The DRA ruled for tenant and reduced the first stabilized rent charged by landlord. In calculating the fair market rent, the DRA allowed apartment improvements costing $5,600. Tenant appealed, objecting to the amount of 1/40th improvements added to the rent. The DHCR ruled against tenant. Landlord submitted proof of the cost of labor and materials for kitchen renovations. Landlord removed all old cabinets, appliances, and flooring and installed new cabinets, appliances, and a new kitchen floor, with new plumbing and electric outlets included. The DRA correctly included 1/40th of the cost of the improvements in the calculation of the legal rent.
