New Flooring Qualifies for Increase

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. The DRA had disallowed any rent increase for new flooring installed in the apartment by landlord before tenant moved in. The DHCR ruled for landlord. The installation of new floors throughout the apartment was an improvement, not a repair. Landlord could get a 1/40th rent increase for this work.
