The DRA disallowed some of landlord's claimed 1/40th improvement costs, including the $21,000 cost for new flooring that landlord had proved. Landlord appealed and won. Landlord was entitled to a rent increase for the new flooring. So tenant's first legal rent was over $2,000 per month and the apartment was deregulated.
