Loose Rubbish Not Yet Placed Out for Collection

DOS issued a violation notice to landlord for ''loose rubbish.'' The notice stated that large appliance boxes filled with other cardboard pieces weren't tied and were likely to be blown about. Landlord claimed the boxes were on his property and that he was going to move them into his yard. Landlord showed photographs of the location of the boxes. The ALJ ruled against landlord and fined him $50. Landlord appealed. ECB ruled for landlord and revoked the fine. The pictures showed that the boxes were within a fenced-in area behind landlord's property line. They weren't loose rubbish left at the curb for collection.
