Landlord Not Required to Accept Packages Needing Signature

Tenant complained that landlord's building staff stopped accepting packages for him after tenant sued landlord for losing a package. The DRA ruled that accepting packages that didn't require a signature was a required service, since landlord had always provided that service to tenant. Tenant appealed, claiming that landlord also was required to accept packages that required a signature. The DHCR ruled against tenant.

Tenant complained that landlord's building staff stopped accepting packages for him after tenant sued landlord for losing a package. The DRA ruled that accepting packages that didn't require a signature was a required service, since landlord had always provided that service to tenant. Tenant appealed, claiming that landlord also was required to accept packages that required a signature. The DHCR ruled against tenant. Landlord showed that it was its policy not to accept packages that required a signature except at times when tenants signed waivers freeing landlord from any liability for loss of the package. If landlord occasionally accepted a package for tenant requiring a signature, this was accidental and didn't indicate any change in landlord's policy.
