Landlord applied for MCI rent hikes based on the installation of new windows. The DRA ruled for landlord. Tenants appealed, complaining that the replacement of the old wooden windows with new wooden windows was merely cosmetic. The DHCR ruled against tenants. Landlord was required to install wooden windows by the Landmarks Preservation Commission. These windows qualified as an MCI.
