Landlord Can Install Elevator That Will Block Tenants' Windows
LVT Number: #24491
Landlord asked the DHCR for permission to install an elevator in its building. The DRA ruled for landlord on condition that it comply with any applicable government regulations for elevator installation and that tenants of Apartments 2C and 6C receive a permanent $8 monthly rent reduction because they each lost the use of one of their kitchen windows. Tenants appealed and lost. They claimed that the rent reduction ordered was insufficient. The amount of the rent reduction ordered met requirements of DHCR practice and policy.
