Increase Takes Effect After Violations Corrected

Landlord applied for MCI rent hikes based on the installation of a boiler/burner and water tank. The DRA ruled for landlord. Tenants appealed, claiming that there were immediately hazardous violations pending at the time the DRA's order was issued. The DRA ruled for tenants in part. The hazardous violations weren't in effect on the date the order was issued but were in effect on the earlier effective date of the MCI rent hikes. The rent hikes were delayed to take effect after the date that the violations were certified as corrected.
