Garage Services Modified

Landlord asked the DHCR for permission to modify services by removing the staffed parking service and instituting self-parking. The DRA granted landlord permission to convert the garage service provided that landlord assign individual parking spaces, install an electronic door opener allowing each tenant with a parking space entry and exit, and maintain security in the facility. Tenants appealed, claiming that they weren't given a chance to answer landlord's application. The DHCR sent the case back to the DRA for reconsideration.

Landlord asked the DHCR for permission to modify services by removing the staffed parking service and instituting self-parking. The DRA granted landlord permission to convert the garage service provided that landlord assign individual parking spaces, install an electronic door opener allowing each tenant with a parking space entry and exit, and maintain security in the facility. Tenants appealed, claiming that they weren't given a chance to answer landlord's application. The DHCR sent the case back to the DRA for reconsideration. While the case was being reconsidered, landlord amended its application to include additional security measures, such as security cameras, and proposed a reduction in garage rent and a one-year waiver of garage rent. Tenants claimed that landlord's plan decreased garage security. The DRA again ruled for landlord on the additional conditions that landlord provide security cameras, paint the garage a light color, provide additional lighting and security at the windows, permanently reduce garage rents by 20 percent, and give up garage rents for a year. Tenants appealed again. The DHCR ruled against tenants. Landlord's application was based on the fact that the garage wasn't used as much as it had been in the past and that attendants were no longer needed to maximize the parking area. Landlord offered to provide a sufficient substitute service with adequate security measures.
