Landlord sued to evict rent-stabilized tenant for nonprimary residence. The court ruled for landlord, finding that tenant didn't maintain an ongoing, substantial, physical connection with the apartment for actual living purposes. Tenant appealed and lost. Tenant owned and lived in a house in Millbrook, where he operated a rental property business. Tenant's driver's license and car registration listed the Millbrook address. His house mortgage required him to live in the house for six months a year.
