Documentary Evidence Showed Tenants Lived in Hampton Bays

LVT Number: 16586

Landlord sued to evict rent-stabilized tenants for nonprimary residence. Tenants owned a house in Hampton Bays but claimed that it was merely a second, part-time residence. The court ruled for landlord. Tenants appealed and lost. At the trial, landlord presented tax returns, voting and auto registration, and bank statements referencing tenants' Hampton Bays address. Telephone records also showed tenants were at the house on a regular basis. Tenants' testimony was vague and nonspecific and didn't warrant a different finding.
