Compactor and Community Rooms Properly Maintained

Rent-stabilized tenants complained of a reduction in building-wide services. They claimed that landlord had reduced community room services by building an illegal wall to facilitate the rental of the community room to illegal tenants. They also claimed that the compactor rooms were in need of extreme maintenance. Tenants stated that the door knob and latch were missing from one, that there was peeling paint and plaster in another, and that there were rusty compactor room cradles and chute doors.

Rent-stabilized tenants complained of a reduction in building-wide services. They claimed that landlord had reduced community room services by building an illegal wall to facilitate the rental of the community room to illegal tenants. They also claimed that the compactor rooms were in need of extreme maintenance. Tenants stated that the door knob and latch were missing from one, that there was peeling paint and plaster in another, and that there were rusty compactor room cradles and chute doors. Landlord responded that the occupant of the community room had moved out and that other services were being maintained. The DRA ruled against tenants and dismissed their complaint.

Tenants appealed and lost. The DHCR's inspector found the compactor room to be properly maintained. The community room looked like a vacant apartment, but the door was marked "community room" with an instruction that tenants could call the management office for availability.
