Window Guards Not Installed at Time of DHCR Inspection

Rent-stabilized tenant complained of a reduction in services based on landlord's removal of window guards. The DRA ruled for tenant and reduced his rent. Landlord appealed and lost. Landlord claimed that, at the time of the DHCR's inspection in January 2013, all necessary repairs had been made and that tenant must have removed the window guards. But tenant claimed that window guards weren't installed until February 2013. DHCR inspection on Jan. 16 showed that other conditions had been repaired and that window guards were on the floor but hadn't been installed in the windows. Landlord never notified the DRA that other repairs had been made and didn't attend the inspection, despite receiving notice from the DRA of the date and time.
