Violation Notice Improperly Served

DOB issued a violation notice to landlord for not maintaining safe elevators. Landlord claimed that the individual served with the violation notice wasn't landlord's employee, and so, wasn't authorized to accept service. The ALJ dismissed the violation because the person served with the notice wasn't landlord's employee. DOB appealed, and ECB ruled for landlord. DOB didn't rebut landlord's evidence, which showed that the person served with the notice wasn't landlord's employee.
