Venetian Blinds Required

Tenant objected to landlord's 1984 building service registration. Tenant claimed that landlord didn't list venetian blinds on the registration form. The DRA found that tenant's lease provided for venetian blinds, so they're a required service and must be listed on the landlord's service registration. Landlord appealed, claiming that blinds were never provided to tenant or any other tenant in the building. Landlord claimed that the blinds were left behind in the apartment by the prior tenant. The DHCR denied landlord's PAR.

Landlord appealed, claiming that blinds were never provided to tenant or any other tenant in the building. Landlord claimed that the blinds were left behind in the apartment by the prior tenant. The DHCR denied landlord's PAR. If a prior tenant abandoned equipment in the apartment, it became the property of landlord. Since landlord left the blinds up, they became a required service. It didn't matter that tenant's initial lease didn't mention the blinds.
