Landlord applied for MCI rent hikes based on the installation of a new boiler/burner. The DRA ruled against landlord. Landlord appealed and lost. Landlord had gotten a prior MCI increase for the old boiler/burner. The old boiler/burner was less than 20 years old when landlord replaced it. Landlord didn't show that the old boiler/burner couldn't be repaired and didn't seek prior approval for a waiver of the useful life requirement.
