Useful Life of Old Burner Didn't Expire

LVT Number: 14939

Landlord applied for MCI rent hikes based on the installation of a new burner. The DRA ruled against landlord. Landlord appealed and lost. The DHCR has determined the useful life of a burner to be 20 years. Landlord's old burner was less than nine years old. And there were no unique or peculiar circumstances in this case. The burner replacement wasn't required by law or any government agency and didn't involve a conversion from oil to gas fuel.
