Trash Left Out on Noncollection Day

DOS issued a violation notice to landlord for not storing trash receptacles. The inspector found two garbage pails and five trash bags left out for collection in front of the building on a day when no garbage collection was scheduled. Landlord claimed that construction workers at the building moved the trash out from the building temporarily and took it back in later the same morning. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. The ALJ didn't believe landlord's claim, and it didn't matter who put the trash out or how long it was there.
