Landlord Didn't Put Trash at Curbside on Noncollection Day

DOS issued a violation notice to landlord for leaving two garbage receptacles and a black bag out for collection on a noncollection day. Landlord objected. She said that she kept a metal receptacle behind hedges in her front yard. On the day in question, her granddaughter was cleaning and temporarily placed a brown receptacle in front of the building near a metal receptacle. She was carting other refuse to the driveway where garbage was stored between collection times. The ALJ ruled against landlord and fined her $100. Landlord appealed. ECB ruled for landlord and revoked the fine. Landlord's testimony was believable, and the violation notice didn't state where in front of the building the receptacles were found.
